Human Rights Lawyer Alleges Complainant Instigated Multiple Charges Against Him

Human rights activist and lawyer, Barrister Victor Giwa, has informed a Federal Capital Territory High Court that Asabe Waziri, the nominal complainant in a property dispute case, allegedly instigated the Office of the Attorney-General of the Federation (AGF), through the Director of Public Prosecution and the Inspector-General of Police, to file five separate charges against him.

Speaking during proceedings before Justice Samira Bature, Giwa, who is representing himself in a case of unlawful eviction, claimed that Waziri’s actions were aimed at securing an arrest warrant against him and disseminating it through the media.

“My lord, it is important to determine the jurisdiction of this court to hear this matter before proceeding. The nominal complainant has the agenda of ensuring that she pushes the prosecution to request a bench warrant against the defendants,” Giwa told the court.

He further noted that he had filed a motion challenging the court’s jurisdiction to hear the case. Giwa also requested that the charges be struck out due to the absence of the prosecution counsel in court and the lack of notification to the defendants regarding the adjournment.

The court, however, directed that the prosecution be given another opportunity to appear on the next adjourned date. Giwa urged that the court first consider his jurisdictional challenge during the next sitting.

Justice Bature adjourned the matter to February 3, 2026, for Giwa to argue his motion on jurisdiction.

The case involves the AGF suing Giwa and co-defendants, Cecil Osakwe and Inspector Edith Erhunmuuse, over allegations of unlawful eviction.
