Ashley St. Clair, who alleges that Elon Musk is the father of her infant son, has filed for sole legal custody, claiming the billionaire entrepreneur has seen the child only three times since his birth in September 2024. In newly revealed legal filings, St. Clair also asserts that Musk once told her, “We have a legion of kids to make.”
Legal Filing Details: St. Clair Seeks Sole Custody and Paternity Declaration
The 26-year-old author and conservative influencer filed a paternity petition and custody request on February 21, 2025, in the Supreme Court of the State of New York, County of New York. The legal documents allegedly include messages between St. Clair and Musk, 53, where he acknowledged their sexual relationship multiple times following the birth of their child, referred to as R.S.C. in the filings.
According to the court documents:
- St. Clair and Musk began a romantic relationship in May 2023.
- The child was conceived in January 2024.
- Musk last visited R.S.C. on November 30, 2024, for just 30 minutes.
- He allegedly missed the child’s birth and has not been involved in his care.
Alleged Private Messages Between Musk and St. Clair
As per St. Clair’s legal filing, Musk’s messages allegedly indicate his awareness of their relationship and the child’s existence.
- On November 24, 2024, Musk allegedly responded to a selfie from St. Clair with, “Hi cutie.”
- St. Clair replied, “See u soon.”
- Musk allegedly wrote back, “I want to knock you up again.”
Weeks later, during a conversation on February 2, 2025, St. Clair reportedly sought an in-person discussion with Musk about their strained relationship, saying, “I truly wish [things] were better for the sake of our son.” Musk allegedly responded with a brief “Hmm ok.”
St. Clair then sent Musk a meme of Jim Carrey’s “Alrighty then” catchphrase from Ace Ventura. In response, Musk allegedly wrote, “Well, we do have a legion of kids to make.”
St. Clair’s Legal Action Against Musk
St. Clair is asking the court to:
- Declare Musk as the father of her child.
- Issue an order of support.
- Grant her sole legal custody.
Her representative, Brian Glickich, stated:
“Ashley St. Clair has filed paternity and custody petitions to protect the best interests of her child. She has made every effort to collaborate with Mr. Musk before taking this step.”
St. Clair’s lawyer, Karen B. Rosenthal, further claimed that Musk’s legal team has been unresponsive and unwilling to resolve custody and support matters amicably.

Musk, CEO of Tesla and SpaceX, has fathered 13 children with four different women, including Grimes and Shivon Zilis. His representatives have not yet responded to the legal claims made by St. Clair.
