
Blake Lively has asked a federal judge to sanction It Ends With Us producer Jamey Heath, alleging he failed to provide critical evidence in her ongoing sexual harassment lawsuit against director and co-star Justin Baldoni.
Lively Alleges Producer Withheld Video Evidence
In a letter filed on November 3, 2025, Lively’s legal team told U.S. District Court Judge Lewis J. Liman that Heath has not complied with a court order to produce materials by the September 2 deadline. Specifically, Lively referenced footage of Heath’s wife giving birth, which she claims was shown to her on set “without warning or consent.”
According to Lively’s attorneys, Heath has provided only a three-minute excerpt of the video, which she maintains does not match what she was shown during filming. The actress contends that Heath’s counsel initially denied the existence of any additional footage but later revealed its existence in a deposition.
“Mr. Heath’s counsel has refused to produce any further video on the sole basis that, in their view, the Order Compelling Production should be read exceedingly narrowly,” the court filing states. Lively’s team argues that withholding the full footage is “plainly improper” and inconsistent with her recollection of events.
Lively Seeks Court Intervention
Lively is requesting that Judge Liman:
- Order Heath to produce all footage related to the birth video within three days.
- Prohibit Heath from presenting any evidence, including testimony, related to showing the birth video.
Background: Allegations on Set
Lively’s sexual harassment lawsuit, filed on December 20, 2024, alleges disturbing and unprofessional behavior by Baldoni and Heath during production, including sharing personal sexual experiences and entering her trailer uninvited. She claims Heath showed her and her on-set assistant a graphic, fully nude video of his wife’s birth, which she initially believed to be pornography. Lively stated that when she questioned whether his wife knew the footage was being shared, Heath replied, “She isn’t weird about this stuff.”
Connection to Baldoni’s Defamation Case
Baldoni later filed a $400 million defamation countersuit against Lively and Ryan Reynolds, which was formally ended by Judge Liman on October 31, 2025. The judge noted that Baldoni and Wayfarer Studios missed the deadline to amend their complaint after the initial dismissal in June 2025.
