Justin Baldoni Claims Blake Lively Improvised Kiss in Deleted It Ends With Us Scene Amid Legal Battle

New Footage Shows Alleged Unscripted Kiss

Justin Baldoni’s legal team has disclosed a minute-long clip from a deleted scene of It Ends With Us, alleging that Blake Lively improvised a kiss with Baldoni in a hospital scene. The footage, submitted as part of the Wayfarer parties’ motion for summary judgment on November 13, 2025, depicts the characters Ryle and Lily sharing a brief kiss.

According to Baldoni’s attorneys, the scene was filmed on May 19, 2023, and Lively “oversaw” the filming. They claim she added the kiss to every take, despite it not being part of the original script.

Background: Lively’s Original Allegations

Blake Lively, 38, previously sued Baldoni, 41, and other production team members for sexual harassment and retaliation, which he has denied. In her complaint, Lively alleged that Baldoni had inserted unscripted kisses into scenes without her consent.

When filming resumed in January 2024 after Hollywood strikes, Lively reportedly presented a long list of conditions for returning to work, including a stipulation that no unscripted kissing occur on set. Baldoni’s legal team now contends that the newly disclosed footage predates that agreement, suggesting that Lively herself improvised the kiss before the strike.

Legal Implications

Baldoni’s $400 million countersuit, filed in January 2025, originally addressed claims of improvised kissing but was later dismissed by the judge. In that filing, his lawyers maintained that the only kissing scenes filmed before the strike were scripted and not improvised.

The newly disclosed hospital scene adds a layer of complexity to the ongoing litigation, which remains scheduled for trial in March 2026. Both Baldoni and Lively are expected to testify, and the motion for summary judgment filed on November 13 asks Judge Lewis J. Liman to rule in Baldoni’s favor without proceeding to trial.

Statements from Both Sides

Lively’s legal team continues to allege retaliation, claiming that negative content about her was amplified and manipulated by Baldoni, Wayfarer Studios, and associated parties, including social media consultant Jed Wallace.

Baldoni’s attorney, Bryan Freedman, reiterated in a November 4 statement that they are focused on Lively’s claims and are committed to pursuing the facts:

“We remain fully committed to pursuing the truth through every legal and factual avenue available and look forward to our day in court.”

Trial Set for March 2026

The trial in the Southern District of New York remains on track for March 2026, with the deleted hospital scene likely to be part of the evidence considered. The legal battle has drawn significant attention due to its high-profile nature, the involvement of celebrity defendants, and the ongoing debate over consent, improvised acting, and workplace conduct in Hollywood.
