K1 De Ultimate Withdraws Suit to Block Awujale Installation

Fuji music legend Wasiu Ayinde, popularly known as K1 De Ultimate (KWAM1), has officially withdrawn his legal suit at the Ogun State High Court, Ijebu-Ode, which sought to prevent the installation of the next Awujale of Ijebuland.

The withdrawal was filed on December 22, 2025, through a Notice of Discontinuance, following correspondence from the Chairman of Ijebu-Ode Local Government Area requesting the court to record the discontinuance and issue any necessary orders.

Earlier, Justice A. A. Omoniyi had declined to grant an ex parte motion for an interim order to halt the installation. The court emphasized that such interim orders require motions on notice and an undertaking as to damages, in line with established Supreme Court precedents, including Seven Up v. Abiola and City Express v. LASG.

“Where a procedure is laid down for making an order, that’s the only way to get the order. It is fatal to an application for an interim order to not file a motion on notice. Additionally, there’s no undertaking as to damages, which is absolutely vital. The application fails and is refused,” Justice Omoniyi stated.

The Notice of Discontinuance, signed by Dr. Wahab Shittu, SAN, indicated that the suit was originally filed following correspondence from the 2nd respondent on December 2, 2025, which has since been withdrawn.

“The Applicant respectfully prays that the Honourable Court record the discontinuance of this suit and make orders as it deems fit,” the notice read.

With this development, the path is now clear for the formal installation of the new Awujale of Ijebuland, ending the legal challenge that briefly stalled the process.
